Terms & Conditions

And now for the boring stuff!!! Just so we can all be sure where we stand and get our ducks in a line, please take the time too read the below T&C's and if your happy then lets get our adventure going!!

TERMS & CONDITIONS

 

All expeditions, courses and private guiding contracted with The Company shall be subject without exclusion to the following Terms and Conditions.

 

In these Terms and Conditions, the following definitions apply:

 

“The Agreement” is the Letter of Agreement and Terms and Conditions.

“The Company” is ClimbAxe Mountaineering

“The Client” is the person, organisation, company or other body responsible for booking the event.

“The Expedition” is the event in respect of which the Client has made a booking.

 

Failure to return and agree the Agreement and pay the initial deposit if applicable may cause The Company to release the reservation and re-book the space with another client.

 

1. BOOKINGS

All bookings will be held on a provisional basis for a limited period, as outlined by The Company in the Agreement. If this signed Agreement and initial deposit (if applicable) have not been received by this date; all expeditions are subject to release without further notice. The Company will continue to accept bookings after this date/s only on a space available basis and subject to full-published rates.

 

2. PAYMENT

Unless otherwise agreed in writing.

  • The Company reserves the right to seek payment of a deposit at any time prior to the expedition/course/private guiding, the amount of which will be determined by the Company. The Company may also require full pre-payment before any expedition/course/private guiding and if this is the case then 30% deposit will be required with the confirmation of booking and the remaining 70% of the estimated total value of the expedition/course/private guiding to be paid one month or less before the expedition/course/private guiding

  • The Company reserves the right to retain any payments received following the cancellation of the booking in accordance with the cancellation charges set out in Clause 3.

  • The payment of all sums due from The Client shall be made within fourteen days of receipt of the account.

 

 

3. CANCELLATION BY THE CLIENT

If the Client cancels an expedition, course or private guiding, the following charges will be due.  In each case, the percentage charge applies to the estimated total for the booking as outlined in Letter of Agreement.

  • 12 weeks or more prior to your event – Deposits are non-refundable.

  • 9 – 12 weeks prior to your event date – 25%

  • 6 – 9 weeks prior to your event date – 50%

  • 3 – 6 weeks prior to your event date – 80%

  • Less than 3 weeks prior to your event date – 100%

 

The Company will waive or refund at its own discretion all or portion of assessed cancellation fees, if lost revenue can be recovered by the sale of cancelled or released expeditions, courses, or private guiding to another client. ClimbAxe Mountaineering advise that all clients take out a cancelation insurance. www.thebmc.co.uk

 

4. CANCELLATION BY THE COMPANY

4(1) Should the Company need to make any amendments or cancellation to the Client’s booking a full refund of all payments made shall be given, or another date shall be offered if suitable. The Company will notify the client of such amendments in writing as soon as possible.

 

4(2) The Company may cancel the booking at any time without incurring any liability to the Client:

  • If there are any unforeseen illness to the ClimbAxe Leader

  • If the minimum numbers for the expedition/course to run are not met (although a variation or other option may be offered)

  •  If the Client is more than 14 days in arrears with any payment to the Company.

 

 

5. CONFIRMATION OF BOOKING

  • Minimum guaranteed numbers are as agreed in the course/expedition details. The Client shall give written confirmation of numbers attending the expedition/course/private guiding upon booking.

  • Any failure to pay deposits requested may result in the booking being cancelled.

 

 

6. DAMAGE

The Client shall be responsible for any damage caused to the allocated safety equipment and expedition equipment therein by any act, default or neglect of the Client/s and shall pay to the Company on demand the amount required to make good or remedy any such damage.

 

 

 

7. ADVERTISING

The Company reserves the right to refuse the use of its name, logo or telephone number in any form of advertising or publicity.
 

 

 

8. VARIATION

No variation of this Agreement shall be valid unless it is in writing and signed by, or on behalf of, each of the parties.

 

 

 

9.ENTIRE AGREEMENT

This Agreement and any documents referred to in it constitute the whole Agreement between the parties and supersedes any previous arrangement, understanding or agreement between them relating to the subject matter of this Agreement.

 

10 BMC PARTICIPATION STATEMENT

ClimbAxe mountaineering supports and abides by the British Mountaineering Councils participation statement and strongly suggests that the Client reads and understands its content and meaning. By signing this agreement, you are confirming that you understand the statement and will abide by its content.

 

The BMC recognises that climbing and mountaineering are activities with a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions.
